These Terms & Privacy are the agreement between you and 90WPM, LLC (“Offtrail,” “we,” “us”) when you use our website at offtrail.ai, fill out our intake survey, or purchase a report. They also explain how we handle the information you share. We’ve kept them short and specific on purpose.
Terms of Service
What Offtrail is
Offtrail helps experienced professionals find roles that fit. You tell us what you’re after, and we deliver the research and tools to run your search: an intelligence report on companies and leaders that match, and if you want it, search infrastructure (a CRM and AI setup in your own accounts) to run your networking campaign. We’re a research and tools service for your job search, not a recruiter, staffing agency, employment agency, or your employer. We work for you alone: employers don’t pay us, and we never share your information with them.
No guarantee of a job or outcome
We don’t promise you’ll land an interview, an offer, or a role. Hiring decisions belong to employers, and much of a search is outside anyone’s control. Your report is a starting point: a sharper map, not a placement service.
We’re not the employer
When your report covers a company, role, or leader, we’re providing research, not vouching for them or acting as your agent. We’re not responsible for employers’ postings, hiring practices, or decisions, or for anything that happens between you and them. Verify anything important before you act on it.
You must be eligible
You need to be at least 18 and using Offtrail for your own job search. The information you give us must be truthful and yours to share.
Fees, payment, and refunds
Applying is free. If your application is a fit, we’ll send you sample search paths at no cost. You pay only when you commission work (an intelligence report or a search infrastructure setup) at the price shown when you purchase. Payments are one-time fees, processed by Stripe. We never see or store your full card details.
If you cancel before work begins (your strategy session for a report, or the setup session for infrastructure), we’ll refund you in full. After that, the work is underway and your payment is non-refundable. If we fail to deliver what you purchased, you’ll receive a full refund.
Your report and your tools
Your report is yours to use for your own job search: keep it, act on it, share it with people advising you. The same goes for any infrastructure we set up: the CRM lives in your own accounts, and the prompts, skills, and runbook we hand over are yours to keep and adapt. Don’t resell our deliverables, republish them, or use them to build a competing service. The research draws on public sources, which everyone remains free to use.
Acceptable use
Don’t submit other people’s information without their permission, don’t disrupt or misuse the service, and don’t scrape, copy, or resell it. Use Offtrail in good faith, for your own search.
Your information
Submitting our intake survey and purchasing a report give us permission to use what you share to do the work: evaluate fit, research opportunities, build your report, and contact you about it. How we handle that information is covered in the Privacy Policy below.
Our content stays ours
Offtrail’s name, brand, site, methods, and content belong to 90WPM, LLC. Using the service doesn’t give you rights to them.
No warranties
Offtrail is provided “as is.” We research carefully and review every report, but the underlying information comes from public sources, and we use AI tools in our research; both can introduce errors or leave things incomplete or out of date, so check anything you plan to rely on. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Limit on liability
To the fullest extent the law allows, 90WPM, LLC isn’t liable for indirect, incidental, special, or consequential damages (including lost income or lost opportunities) arising from your use of Offtrail, regardless of the legal theory. Our total liability for all claims combined is limited to the amount you paid us in the past 12 months or $100, whichever is greater. Some jurisdictions don’t allow certain limits, so parts of this section may not apply to you. Any claim must be brought within one year of when it arose.
If your misuse causes a claim
If a third party brings a claim against us because you violated these terms or misused Offtrail, you agree to defend us against it and cover the resulting costs, including reasonable attorneys’ fees.
Ending access
We can update, pause, or stop offering Offtrail, or remove access for violations of these terms, at any time. If we ever cancel a report you’ve paid for before delivering it, we’ll refund you in full.
Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Before either of us files a claim, we agree to try to resolve the dispute informally: email us, and we’ll both have 30 days to work it out. If that fails, disputes will be resolved exclusively in the state or federal courts located in New York County, New York, and we each consent to jurisdiction there.
The usual fine print
If a court finds part of these terms unenforceable, the rest still stands. These terms are the entire agreement between us about Offtrail. If we don’t enforce a provision, we’re not waiving it. You can’t assign these terms to anyone else; we may assign them if our business is acquired or reorganized.
Privacy Policy
The short version
- Our website uses only privacy-first, cookieless analytics, with no advertising trackers and no cookies.
- We collect what you submit in our intake survey, payment details handled by Stripe, and anything you email us.
- We never share your information with employers, never sell it, and never share it for advertising.
- You can ask us to delete your information any time, and we will. Email privacy@offtrail.ai.
What we collect
We collect information in three ways:
- Intake survey: your name, email address, and LinkedIn profile URL, plus career details such as years of experience, seniority, the roles and employers you’re targeting, location and remote-work preferences, what you value in a role, companies you admire, and anything you write in open-ended fields. Please share only what you’re comfortable with.
- Payment: handled by Stripe. We see your name, email, and payment status, never your full card number.
- Correspondence: if you email us, we keep the thread.
Strategy and setup sessions are live conversations: we don’t record them or keep transcripts of them.
We don’t ask for and don’t want sensitive information like your Social Security number, financial details, health information, or precise location.
Why we collect it
We use your information to understand the role and employer you’re looking for, decide whether Offtrail is a fit, build your report, process your payment, and contact you about next steps. That’s the whole list. We don’t use it for advertising or build a profile for anyone else.
Analytics
We use Fathom Analytics to understand how people find and use our site. Fathom is privacy-first and cookieless: it doesn’t set cookies, doesn’t track you across other websites, and doesn’t build profiles of you. We only see aggregate traffic data.
We never share your data with employers or sell it to anyone
Money at Offtrail flows in one direction: you pay us. Employers don’t pay us, and we never share your information with them: not the companies in your report, not recruiters, not anyone in between.
We don’t sell your personal information, and we don’t share it for cross-context behavioral advertising, under any definition, including California’s. Many people use Offtrail while they’re still employed. We treat your search as confidential and won’t disclose it to your current employer or anyone else, except as described in the next two sections.
Who else handles your data
We use a few providers to run Offtrail. They process your information only to provide their service to us:
- Tally (tally.so): hosts our intake survey and stores responses.
- Stripe: processes payments.
- Anthropic: we use Claude, an AI assistant, to help research and assemble your report. Under our commercial agreement, Anthropic doesn’t use your information to train its models.
- Google: delivers and stores survey notifications and email in our inbox.
- Amazon Web Services: stores survey data securely.
We don’t allow these providers to use your information for their own purposes.
When we might have to disclose
We’ll disclose information if the law requires it (a subpoena, court order, or similar legal process) or where it’s necessary to protect our legal rights or prevent fraud. And if Offtrail or 90WPM, LLC is ever acquired or reorganized, your information may transfer with the business; this policy would still apply to it, and we’d let you know.
How long we keep it
We keep your information as long as we’re working together or it’s useful for your search, or until you ask us to delete it. When you ask, we delete it from our systems and instruct our providers to do the same; copies in routine encrypted backups age out on schedule.
Your rights, everywhere (including California)
Wherever you live, you can ask us what we have about you, request a copy, and have us correct or delete it, and we’ll never treat you differently for asking. California residents have these rights by law (to know, access, correct, delete, and not be discriminated against); we extend them to everyone. Since we don’t sell or share personal information, there’s nothing to opt out of on that front. Email privacy@offtrail.ai. We’ll verify your request against the email on file before acting, and respond within the timeframes the law requires.
Children
Offtrail is for working professionals and isn’t directed at anyone under 18. We don’t knowingly collect information from children.
Security
We use reasonable measures to protect your information and rely on established providers to store it. No system is perfectly secure, but we limit who can access your data and collect only what we need.
Changes
If we change this agreement, we’ll update the effective date above and email you about material changes if you have a report in progress. If we ever want to use information we’ve already collected in a meaningfully different way, we’ll ask you first. Using Offtrail after a change takes effect means you accept it.
